303 Creative, Inc. v. Elenis, asked the Court whether a website designer that has chosen to open a business to the public has a constitutional right to discriminate against customers on the basis of their sexual orientation.
In a 6-3 decision, the Court ruled that the Colorado anti-discrimination law violates the First Amendment, siding with 303 Creative that refused to provide a website for a same sex marriage.
This decision undermines the civil rights laws that protect all of us from discrimination in our daily lives. No one should have to fear being turned away from a business because of who they are, but that is precisely the future the Court is trying to build with this and other rulings that have communicated its disdain for LGBTQ+ people.
